Immigrant Investor VISA - The E (b)-5 Visa Process
Did you know that permanent resident status based on EB-5 eligibility is available to investors, either alone, or with their spouse and unmarried children? Under Section 203(b)(5) of the Immigration and Nationality Act (INA), 10,000 immigrant visas per year are available to qualified individuals seeking permanent resident status on the basis of their engagement in a new or existing commercial enterprise.
Eligibility is available for those aliens who "have invested or are actively in the process of investing" the required amount of capital towards (1) a new commercial business enterprise, (2) the purchase of an existing business, or (3) the expansion of an existing business. The individual must also demonstrate that the investment will benefit the United States economy and either create new jobs or maintain existing jobs. Permanent resident status becomes available after the successful completion of a two-year conditional residence status.
